Pension Plan Disability Lump Sum Payments

May 1st 1997 and January 14th 1999 some
people receiving Disability Benefits Level II (now
PWD) were asked by the provincial government to apply
for Canada Pension Plan Disability (CPPD) benefits
and to sign a form called a "Consent to Deduct and
Payment." Signing the form meant the person
assigned their CPPD lump sum payment to
the province. The provincial
government now has the legal authority to require
people receiving provincial disability benefits
to sign over their CPPD lump sums, but if you
signed a "Consent to Deduct and Payment"
agreement between May 1st 1997 and January 14th
1999 you may be able to get some of your lump sum
payment back. Kelowna law firm Doak Shirreff
has mounted a class action suit and reached a
settlement. People who participate in the
settlement will receive 50% of their CPPD payment
that was assigned to the province. To be eligible
you must: be a current or former BC resident
who, while receiving disability benefits under
BC's Disability Benefits Program Act,
assigned or transferred CPPD benefits to the BC
government from May 1st 1997 to January 14th 1999
resulting in a CPPD Arrears payment.
To be part of the settlement you must complete the
required legal documents by April 5th 2005.
